This box is a summary. The clauses below are what counts.
1. About these Terms
1.1 These Terms of Service (the "Terms") govern your access to and use of Captu-re, the writing application available at captu-re.com and through any related applications (the "Service"). They form a binding agreement between you and the Provider identified in clause 2.
1.2 By creating an account you accept these Terms and our Privacy Policy. If you do not agree to them, you may not use the Service.
1.3 The Service is offered to consumers — natural persons acting for purposes outside their trade, business, craft or profession — who are resident in the European Union. Nothing in these Terms affects the rights you have under mandatory consumer-protection law.
1.4 These Terms are concluded in English. A Portuguese-language version will be made available; in the event of any inconsistency, the Portuguese version prevails for consumers resident in Portugal.
2. The Provider
2.1 The Service is provided by Joelson Saul Agostinho Castro, a sole trader (trabalhador independente) registered in Portugal, tax identification number (NIF) 286666111, trading as Captu-re.
2.2 Registered address: [OWNER-1 — Portuguese fiscal address, pending].
2.3 Contact for all matters under these Terms, including withdrawal, complaints and support: [OWNER-2 — contact mailbox, e.g. privacy@captu-re.com, pending].
2.4 Payments are processed by Stripe Payments Europe, Ltd. ("Stripe"). Stripe acts as our payment service provider; it is not a party to these Terms.
3. Definitions
"Account" means the personal account you create to use the Service.
"Billing Period" means the monthly or annual period for which a Paid Plan is charged in advance.
"Content" means the text you write in the Service, together with any material you upload to it.
"Free Plan", "Plus" and "Founding Writer" have the meanings given in clause 6.
"Paid Plan" means Plus or Founding Writer.
"AI Features" means the features described in clause 11 that rely on a third-party artificial-intelligence provider.
"Privacy Policy" means the privacy policy published at captu-re.com/privacy, as updated from time to time.
"Withdrawal Form" means the model form published at captu-re.com/withdrawal (clause 9.2).
4. Eligibility and age
4.1 You must be at least 18 years old to create an Account. By creating an Account you confirm that you are 18 or older and have the legal capacity to enter into this agreement.
4.2 We may suspend or close any Account that we reasonably believe belongs to a person under 18, and we will delete the associated personal data in accordance with the Privacy Policy.
5. Your Account
5.1 You may register with an e-mail address and password or through Google sign-in. Registration requires you to confirm, by two separate and unticked checkboxes, that (a) you are 18 or older and (b) you have read and accept these Terms and the Privacy Policy. We record the version of the Terms you accepted and the time of acceptance.
5.2 You must provide accurate information and keep it up to date. You are responsible for all activity under your Account and for keeping your credentials confidential. Tell us without delay if you suspect unauthorised use.
5.3 An Account is personal to you. It may not be shared, transferred or used by more than one person.
6. Plans and prices
6.1 The Service is available on the following plans. All prices are in euro and include Portuguese VAT (IVA) at 23 %.
| Plan | Price | Billing |
|---|---|---|
| Free Plan | € 0 | — |
| Plus | € 4.99 per month, or € 39 per year | Monthly or annual, in advance |
| Founding Writer | € 29 for the first year, then € 39 per year | Annual, in advance |
6.2 Founding Writer is an introductory annual plan. The introductory price applies to the first year only; from the second year the plan renews at the standard annual price of € 39 unless you cancel under clause 8.
6.3 We do not offer lifetime plans, multi-seat or team plans, or any plan not listed above. Nothing in the Service, our website or our communications should be read as offering one.
6.4 Tax. The Service is offered to consumers. All prices include Portuguese VAT and all invoices are issued with Portuguese VAT; we do not apply the intra-EU reverse-charge mechanism. Customers resident outside the European Union are not charged Portuguese VAT.
6.5 Invoicing. For each charge we issue a fatura-recibo (the Portuguese invoice-receipt) under Portuguese tax law, addressed to you as a consumer. We do not collect tax identification numbers, so invoices are issued without a customer NIF.
6.6 Price changes. We may change the price of a Paid Plan for future Billing Periods. We will notify you by e-mail at least 30 days before a price change takes effect. If you do not wish to accept the new price, you may cancel under clause 8 before it takes effect; the change will not apply to a Billing Period you have already paid for.
7. Free trial
7.1 Plus includes a 7-day free trial. No payment card is required to start the trial, and no charge is made at the end of it. Each person and each Account is entitled to one trial only.
7.2 When the trial ends, your Account returns to the Free Plan unless you have chosen to subscribe to a Paid Plan. Subscribing during or after the trial is a separate purchase made through checkout under clause 8.
8. Subscription term, renewal and cancellation
8.1 A Paid Plan begins when your first payment is confirmed and continues for the Billing Period you selected.
8.2 Automatic renewal. At the end of each Billing Period your Paid Plan renews automatically for a further Billing Period of the same length, at the price then applicable under clause 6, and the renewal fee is charged to your payment method. We send you a reminder e-mail 3 days before each renewal charge.
8.3 Cancellation. You may cancel your Paid Plan at any time in your Account settings. Cancellation takes effect at the end of the current Billing Period; you keep access to the Paid Plan until then, and no further charge is made. Except as provided in clauses 9 and 10, amounts already paid for the current Billing Period are not refunded.
8.4 Failed payments. If a renewal charge fails, we will notify you and allow a grace period of 7 days to update your payment method. If payment has not succeeded by the end of the grace period, your Account returns to the Free Plan. Your Content is not deleted on downgrade.
8.5 You may also delete your Account entirely at any time (clause 15).
9. Right of withdrawal (EU consumers)
9.1 As a consumer resident in the European Union you have the right to withdraw from a Paid Plan within 14 days of the day on which you subscribed to it, without giving any reason. This right applies to your first purchase of a Paid Plan; it does not arise again on automatic renewal.
9.2 To exercise the right of withdrawal you must inform us of your decision by an unequivocal statement — for example an e-mail to the address in clause 2.3. You may use the Withdrawal Form published at captu-re.com/withdrawal, but you are not obliged to. To meet the deadline it is sufficient that you send your statement before the 14-day period has expired.
9.3 Immediate start and its consequence. Captu-re is a service supplied continuously over the Billing Period. At checkout you may ask us to begin supplying the Paid Plan immediately, before the 14-day period has ended. If you do so, and you later withdraw within the 14 days, you will owe us an amount for the service supplied up to the moment you informed us of your withdrawal, calculated in proportion to the full price of the Paid Plan for its Billing Period. We refund the remainder. Asking for immediate start does not cause you to lose the right of withdrawal.
9.4 If you do not ask for immediate start, the Paid Plan begins on the day after the 14-day period ends, and withdrawal within that period is free of charge.
9.5 We will refund any amount due to you without undue delay and in any event within 14 days of the day we are informed of your withdrawal, using the same means of payment you used for the purchase, unless you expressly agree otherwise.
9.6 The immediate-start request is made by a separate, unticked checkbox at checkout, worded as follows: "I ask Captu-re to start my paid plan immediately. I understand that if I withdraw within 14 days, I will pay a proportional amount for the service supplied up to the date of my withdrawal." This checkbox is distinct from the registration confirmations in clause 5.1 and is shown only when a Paid Plan is first purchased.
10. Refunds
10.1 Withdrawal. Refunds on withdrawal are governed by clause 9.
10.2 Discontinuation of the Service. If we decide to close the Service, we will give you at least 30 days' notice by e-mail and refund the unexpired part of any Billing Period you have paid for, calculated pro rata from the closure date.
10.3 Statutory conformity. Nothing in this clause limits the remedies you have under clause 13 if the Service does not conform to the contract.
10.4 Goodwill refunds. Outside the cases above we may, at our sole discretion, grant a refund in whole or in part. A goodwill refund in one case does not create an entitlement in any other.
10.5 Chargebacks. If you dispute a charge with your card issuer or bank rather than contacting us, the dispute is handled through Stripe's dispute process. We may suspend access to the Paid Plan while a dispute is open and reinstate it once the dispute is resolved in our favour or the charge is settled.
11. AI Features and usage allowance
11.1 The Service includes AI Features — post-writing correction, content improvement, live-mode styling, recommendations and reports — that are generated with the assistance of a third-party artificial-intelligence provider. The Privacy Policy describes which parts of your Content are sent to that provider, when, for what purpose and for how long they are retained.
11.2 AI Features are included with your plan subject to a monthly usage allowance that resets on the last day of each calendar month. The allowance for your plan is shown in the Service. AI Features are not unlimited and are not sold as such; once your allowance is used, AI Features become available again at the next reset.
11.3 Material produced with AI assistance is labelled as such within the Service. AI output may contain errors and is provided as a writing aid; you remain responsible for how you use it.
11.4 We may adjust the allowance, the AI Features available on each plan or the provider we use. A change that materially reduces what is included in a Paid Plan you have already paid for will be notified under clause 17, and you may cancel under clause 8.3 if you do not accept it.
12. Your Content and intellectual property
12.1 Your Content is yours. You retain all rights in the Content you create in the Service. We claim no ownership of it.
12.2 You grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, reproduce and display your Content solely to the extent necessary to provide the Service to you, including to operate the AI Features you use. This licence ends when your Content is deleted from the Service, subject to the deletion timelines in the Privacy Policy.
12.3 We do not use your Content to train artificial-intelligence models, and we do not permit our AI provider to do so.
12.4 The Service itself — its software, design, name, logos and all associated intellectual-property rights — belongs to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. No other rights are granted.
12.5 Sharing of Content to third-party platforms (such as X, Facebook or Instagram) happens only when you initiate it, and is subject to those platforms' own terms.
13. Conformity of the Service
13.1 We will supply the Service in conformity with the contract, as required by the law on digital content and digital services. If the Service does not conform, you are entitled to have it brought into conformity, to a proportionate price reduction or, where the lack of conformity is not minor, to terminate the contract, in accordance with the applicable law.
13.2 We will provide updates, including security updates, that are necessary to keep the Service in conformity for as long as you are subscribed.
14. Acceptable use
14.1 You must not use the Service:
- (a) to create, store or distribute content that is unlawful, defamatory, or infringes the rights of others;
- (b) to attempt to gain unauthorised access to the Service, its infrastructure or other users' Accounts;
- (c) to reverse-engineer, decompile, scrape or copy the Service or any part of it, except where the law permits;
- (d) to interfere with the operation or security of the Service, or to circumvent usage allowances;
- (e) to share your Account or resell access to the Service.
14.2 We may suspend or terminate an Account that breaches this clause. Where practicable we will warn you first and give you an opportunity to remedy the breach.
15. Suspension, termination and account deletion
15.1 By you. You may delete your Account at any time in your Account settings. Deletion cancels any Paid Plan with immediate effect; no refund is due for the remainder of the Billing Period except as provided in clauses 9 and 10. The Privacy Policy explains the 30-day recovery window that follows deletion and what is retained afterwards for legal reasons.
15.2 By us. We may suspend or terminate your Account, with notice by e-mail stating the reason, if you materially breach these Terms, if payment for a Paid Plan remains unpaid after the grace period in clause 8.4, or if we are required to do so by law. Where termination is not due to your breach, unexpired prepaid time is refunded pro rata.
15.3 On termination for any reason the licence in clause 12.4 ends, and clauses 12, 16, 18 and 19 continue to apply.
16. Liability
16.1 Nothing in these Terms excludes or limits our liability for death or personal injury, for fraud, for wilful misconduct or gross negligence, or for any other liability that cannot be excluded or limited under Portuguese or applicable EU consumer law.
16.2 Subject to clause 16.1, we are not liable for loss that was not a foreseeable consequence of our breach, for loss of profit or business, or for loss arising from your breach of these Terms or from causes beyond our reasonable control.
16.3 Subject to clause 16.1, our total liability to you under or in connection with these Terms in any 12-month period is limited to the amount you paid us for the Service in that period.
16.4 The Service is provided for personal writing use. We do not guarantee that it will be uninterrupted or error-free; we will use reasonable care and skill in providing it and will inform you of planned interruptions where practicable.
17. Changes to these Terms
17.1 We may amend these Terms. Each amended version carries a new version identifier and date at the top of this page.
17.2 Material changes — including changes to prices, to your rights or obligations, to what we process or share, to the AI provider or to the AI Features included in a plan — will be notified to you by e-mail at least 30 days before they take effect. Where the law requires your agreement, you will be asked to accept the new version before it applies to you; if you do not accept it, you may cancel under clause 8.3 without penalty before it takes effect, and the previous version continues to apply until then.
17.3 Changes that are purely editorial (clarifications, corrections, formatting) do not alter the version identifier and take effect on publication.
17.4 The version of the Terms you accepted, and the date of acceptance, are shown in your Account settings.
18. Complaints and dispute resolution
18.1 If you have a complaint, please contact us first at the address in clause 2.3. We aim to respond within 10 working days.
18.2 Complaints book. As a provider of services to consumers in Portugal we are subject to the electronic complaints book (Livro de Reclamações Eletrónico), available at livroreclamacoes.pt. [OWNER-3 — confirm the Provider is registered on the platform]
18.3 Alternative dispute resolution. Consumer disputes may be submitted to an alternative dispute resolution entity. [OWNER-3 — competent RAL entity, or CNIACC (Centro Nacional de Informação e Arbitragem de Conflitos de Consumo) as the national fallback, to be named once the address is on record] More information is available from the Direção-Geral do Consumidor at consumidor.gov.pt.
18.4 Using alternative dispute resolution is voluntary for you and does not affect your right to bring a claim before the courts.
19. Governing law and jurisdiction
19.1 These Terms are governed by the law of Portugal.
19.2 If you are resident in another EU Member State, you also benefit from any mandatory provisions of the consumer-protection law of that State, and nothing in these Terms deprives you of that protection.
19.3 You may bring proceedings in the courts of Portugal or in the courts of the Member State in which you are resident. We may bring proceedings against you only in the courts of the Member State in which you are resident.
20. General
20.1 Communications. We communicate with you by e-mail to the address on your Account. It is your responsibility to keep that address current.
20.2 Assignment. You may not transfer your Account or your rights under these Terms. We may transfer our rights and obligations to a successor operator of the Service, provided the transfer does not reduce your rights; we will notify you if this happens.
20.3 Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force.
20.4 No waiver. A failure to enforce any provision of these Terms is not a waiver of it.
20.5 Entire agreement. These Terms, the Privacy Policy and the plan details shown at checkout constitute the entire agreement between you and us regarding the Service. Information required by law to be provided before the conclusion of a distance contract forms an integral part of the contract.
20.6 Contract record. A copy of the version of these Terms you accepted is available in your Account settings; we recommend that you also save a copy.
